A Tightening Grip on Ballast Water Management

For ship operators and agents preparing a vessel for a Port of Brisbane call, regulatory compliance demands precise coordination. While much attention rightly falls on safety management systems, ballast water and biosecurity rules have emerged as primary sources of port state control deficiencies and biosecurity delays. Since the D-2 discharge standard came into full effect, both global port state control regimes and Australian authorities have ramped up their enforcement of the Ballast Water Management Convention.

General safety compliance is already a high bar in Australia. AMSA's 2024 Annual Inspections Report recorded a 5.9% overall detention rate, with Safety Management (ISM) representing the largest category of detainable deficiencies at 27.57%. Between 1 September and 30 November 2025, inspectors scrutinized ballast water compliance across the Asia-Pacific region. The preliminary results of the CIC on Ballast Water Management are telling. Out of 9,244 inspections carried out during the campaign period, the overall detention rate stood at 2.66%.

Crucially, the most frequent deficiency recorded under the campaign was code 14811, which simply asks: "Is the BWMS operational?". This finding confirms that while ships have installed the hardware to meet the D-2 standard, the operation, maintenance, and crew familiarization of these systems remain major hurdles. Inspectors are actively testing whether the system works and whether the crew can operate it without bypassing critical alarms.

DAFF Enforcement and the Biosecurity Act 2015

In Australia, it is crucial to remember that ballast water is regulated federally under the Biosecurity Act 2015. While AMSA administers port state control and the separate anti-fouling systems (AFS) certification, the Department of Agriculture, Fisheries and Forestry (DAFF) manages biosecurity and ballast water rules.

In August 2025, DAFF issued a specific biosecurity alert, Ballast Water Fact Sheet #1, following a sharp increase in non-compliance. Biosecurity officers identified severe operational breaches, including crews ignoring low Total Residual Oxidant (TRO) alarms, vessels taking up or discharging water in bypass mode, and even tampering with sensor settings. Discharging unmanaged ballast water in Australian territorial seas is a direct offence under section 270 of the Biosecurity Act 2015.

Operators must ensure their crews are strictly following Australian ballast water management rules. If a BWTS fails or triggers alarms, the crew must not simply bypass the system. There are exactly three accepted proactive biofouling management practices: operating under a compliant Biofouling Management Plan and Record Book, cleaning the hull and niche areas within 30 days before arrival, or implementing a DAFF pre-approved alternative. A compliant anti-fouling coating alone is not an accepted practice.

Ballast Water Record Book Accuracy

Port state control officers and DAFF biosecurity officers will cross-reference the BWTS control panel logs with the Ballast Water Record Book. Any discrepancy between the electronic logs (such as alarms or bypass events) and the manual record book will immediately escalate the inspection. The record book must follow the latest IMO format and accurately capture all uptake, treatment, circulation, and discharge events.

Preparation is the only reliable defense against biosecurity delays. Superintendents should regularly audit the BWTS electronic logs against the vessel's manual records.
