Ballast Water Rules 2026: Navigating Port State Control
Introduction
Calling at the Port of Brisbane requires strict adherence to environmental regulations. With increasing global focus on marine biosecurity, ensuring your ballast water and hull biofouling management systems are compliant is critical to avoiding costly delays.
DAFF Ballast Water Compliance and the D-2 Standard
Australia regulates ballast water federally under the Biosecurity Act 2015. Ships arriving from international waters must meet the Ballast Water Management Convention D-2 discharge standard, which strictly limits the concentration of viable organisms permitted in discharged ballast water. All operators must submit detailed ballast water information through the Maritime Arrivals Reporting System (MARS) prior to arrival.
The rules for ballast exchange and treatment are rigorously enforced, as detailed in the DAFF ballast water requirements. If your Ballast Water Treatment System (BWTS) experiences an operational failure, you must report it immediately. Reverting to contingency measures requires prior approval from DAFF. Additionally, port state control officers are increasingly conducting indicative sampling to verify that the discharged water actually meets the D-2 biological limits, making routine BWTS maintenance essential.
Record Keeping and Port State Control Scrutiny
AMSA administers Australia's port state control (PSC) regime. According to AMSA's 2024 Annual Inspections Report (published in May 2025), there were 2,264 initial PSC inspections across the country. These resulted in 133 PSC detentions (a 5.9% detention rate) and 5,960 deficiencies, averaging 2.63 deficiencies per inspection. While Safety Management (ISM) was the largest detainable-deficiency category at 27.57%, environmental systems like ballast water treatment face heavy scrutiny from AMSA inspectors.
Global enforcement trends mirror this focus. For example, the Tokyo MOU 2025 Concentrated Inspection Campaign on Ballast Water Management explicitly targeted BWMS operation, proper certification, and accurate Ballast Water Record Book (BWRB) entries. Crews must be intimately familiar with BWMS operations and ensure that any bypasses or challenging water quality scenarios are logged precisely according to the latest IMO guidance, such as BWM.2/Circ.80/Rev.1.
Biofouling Rules and the ABFMR Version 4
While ballast water systems manage suspended organisms, biofouling management addresses the severe biosecurity risks posed by hull-borne species. Biofouling management has been mandatory for vessels arriving in Australian territorial seas from international locations since 15 June 2022. It is important to note that this arrival scheme is administered entirely by DAFF, not by AMSA (which handles the separate anti-fouling systems certification).
The Australian Biofouling Management Requirements for Commercial Vessels (ABFMR-CV) Version 4 took effect on 30 April 2026. Under these rules, commercial operators must implement one of exactly three accepted proactive biofouling management practices. The first is operating under a Biofouling Management Plan and Record Book that is consistent with ABFMR Appendix A. The second is cleaning all biofouling from the hull and niche areas within 30 days before arrival. The third is implementing an alternative management practice that has been pre-approved by DAFF, requiring an application at least 30 days prior to arrival. Note that having a compliant antifouling coating alone is not recognized as one of these accepted practices.
In-Water Cleaning and IMO Biofouling Guidelines
If an operator plans to conduct in-water hull cleaning in Queensland waters to meet arrival requirements, federal capture requirements apply, but they are not the only hurdle. The operation needs separate Queensland approval from Biosecurity Queensland (DETSI). Furthermore, any in-water cleaning report submitted to DAFF must meet the minimum content standards outlined in Appendix B of the ABFMR.
For international context, the IMO recently updated its voluntary framework by adopting the 2023 Guidelines for the control and management of ships' biofouling (Resolution MEPC.378(80)), which supersede the older 2011 guidelines. While the IMO guidelines are voluntary, Australia's ABFMR serves as a binding minimum for entry.
